What is an ADU, exactly?

An Accessory Dwelling Unit (ADU) is a smaller, self-contained home on the same lot as your primary residence. Think a converted garage, a finished basement with its own entrance, a backyard cottage, or an addition attached to the back of your house. They go by many names — granny flats, in-law suites, backyard bungalows — but in Lexington, they're officially called ADUs, and the city has been actively changing its rules to encourage more of them.

Why Lexington is leaning in

Lexington's long-range plan, Imagine Lexington 2045, specifically promotes ADUs as a tool for improving housing affordability and supporting aging residents who want to stay in their neighborhoods. AARP Kentucky has backed these efforts, and the city has steadily loosened restrictions since first allowing ADUs in 2021.

How the rules have evolved

2021 — First ADU Ordinance
Lexington passed its first ADU rules, allowing basement, attic, and garage conversions on single-family lots. Detached new construction was not yet permitted, and owners had to live on the property.
2023 — Significant Expansion
The Urban County Council approved major updates: detached ADUs (brand-new backyard builds) are now permitted, and the owner-occupancy requirement was removed — meaning you no longer have to live on-site to rent out an ADU.
Today — 2026
Applications are growing steadily. The rules are settled, contractors are gaining ADU experience, and Lexington is actively promoting development. This is arguably the best window yet to move forward.

The current rules at a glance

  • One ADU per lot. You can build one ADU on a single-family residential lot — no more.

  • Size cap of 800 sq ft for new builds or additions. Basement conversions are exempt as long as they stay within the home's existing footprint.

  • No owner-occupancy requirement for long-term rentals. You can rent both the main house and the ADU simultaneously.

  • Occupancy limit of 2 adults (plus children in their care) in the ADU.

  • Short-term rentals (Airbnb, VRBO) require a separate Conditional Use Permit from the Board of Adjustment.

  • Design guidelines apply for detached units — one entrance on the primary wall, exterior stairs on the side or rear.

Before submitting any permit application, you're required to attend a pre-application conference with Lexington’s Division of Planning. This free meeting helps you understand your specific lot’s requirements before investing in plans.

The financial case

Adding a legal ADU does two things at once: it creates a rentable asset generating monthly income, and it adds appraised value to your home. Because Lexington removed the owner-occupancy rule in 2023, you're no longer locked into living on the property to benefit — the ADU can be a straightforward real estate investment.
